1. The petitioner who has filed the present writ petition is an Assistant Engineer assailing his transfer order from Rural Engineering Service Sub-Division – Dabhra, District – Janjgir- Champa to Rural Engineering Service, Sub-Division – Pali District – Korba on administrative grounds. 2. Learned counsel for the petitioner would submit that the petitioner is due for retirement on 31.12.2026 as such only 14 months are left for his retirement. For grant of pensionary benefits in time, availability and maintenance of record is very much required which may get disturbed. It will also create difficulty for State to obtain entire records of the petitioner. 3. On the other hand, learned counsel for the State would submit that the petitioner is a gazetted officer, therefore, the respondents have not committed any irregularity in transferring him. 4. I have heard learned counsel for the parties and perused the record. 5.
Considering the submission made by learned counsel for the petitioner that only 14 months time is due for retirement and it is
not in dispute that it creates difficulty in transferring an employee at the verge of retirement. At this juncture, it is directed that the petitioner will file his representation raising his grievance which in turn the respondents shall consider and decide the same in accordance with law. It is also directed to the State to see that before retirement of the petitioner, the records with regard to pensionary benefits shall be completed and if there is no impediment the same shall be released expeditiously on retirement. 6. With the aforesaid observation and direction, the writ petition (S) is disposed of. Sd/- (Narendra Kumar Vyas) Judge kishore
