Act (The Negotiable Instrument Act 1881) Police Station Pilkhua District Hapur pending in the court of Chief Judicial Magistrate Hapur during the pendency of the present case, and further be pleased to quash the impugned summoning order dated 20-1-2023 passed by learned chief judicial magistrate Hapur in criminal complaint case no 809/2022 (new no 120/2024) G.M.M. Foods Vs Firm M/S Agrawal and Agrawal Enterprises under section 138 N.I. Act (The Negotiable Instrument Act 1881) Police Station Pilkhua District Hapur pending in the court of Chief Judicial Magistrate Hapur. 3. Sri Girijesh Kumar Gupta, learned counsel for the applicant on his instructions seeks to withdraw the present application wherein challenge has been raised with liberty to file fresh on account of technical inherent defects. However, he submits that the certified copy be returned subject to furnishing of the photocopy. 4. Learned AGA has no objection to the same. 5. The application is dismissed as withdrawn with aforesaid liberty. 6. Office is directed to return the certified copy of the document which has been filed subject to furnishing of the photocopy.
