THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: ORAL ORDER (PER: THE HON'BLE MR. JUSTICE SURAJ GOVINDARAJ) 1. The Petitioners are before this Court seeking for the following reliefs: a. Issue a writ in the nature of Mandamus directing the Respondents to consider the applications filed by the petitioners dated 20.06.2015 and 17.03.2017 to the offices of Respondents vide Annexure C & Annexure D. b. A writ of mandamus further directing the respondents to appoint the petitioner No.2 to civil services on compassionate basis on account of death of his father Shri Basavannappa Hosamani as per representations dated 20.06.2015 and 17.03.2017 vide Annexure C and Annexure D made by the Petitioner No.2 to the offices of Respondent No.2 & 3. c. Any other writ or direction or order the petitioner is found entitled to in the ends of justice. - 3 - HC-KAR NC: 2025:KHC-D:12841 WP No. 107225 of 2023 2. A short grievance of the petitioner is that the application filed by petitioner No.2 for compassionate appointment on 20.06.2015 and 17.03.2017 at Annexure-C and D respectively have not been considered and no orders have been passed by respondents No.2 and 3. 3. Whenever any application for compassionate appointment is submitted, it is but required for the same to be considered and necessary orders to be passed at the earliest. Since no order has been passed, I pass the following; ORDER i. The writ petition is allowed. ii. A mandamus is issued, directing respondent No.2 to consider the application representation dated 20.06.2015 and 17.03.2017 at Annexure-C and D, respectively, within a period of eight weeks from the date of receipt of a copy of this order. - 4 - HC-KAR NC: 2025:KHC-D:12841 WP No. 107225 of 2023 iii. It is made clear that this Court has not expressed any opinion on the merits. Sd/- (SURAJ GOVINDARAJ) JUDGE SR List No.: 5 Sl No.: 1
