GP FOR REVENUE (AP) 3 HBKM,J W.P.No.7912 of 2020 The Court made the following Order: Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the 4th respondent in resuming the petitioner's lands situated in an extent of Ac.1.41 cents in Sy.No.177/2P and Ac.2.00 cents in Sy.No.180/22 of Kongavanipalem Village, Bhogapuram Mandal, Vizianagaram District through his orders in Rc.No.52/2018/B dated 27.12.2019 and interfering with the petitioner's lands situated in an extent of Ac.0.21 cents in Sy.No.177-4, Ac.0.08 cents in Sy.No.177-8, Ac.0.30 cents in Sy.No.177-9, Ac.2.00 cents in Sy.No.180-20 and Ac.1.35 cents in Sy.No.190-1 of Kongavanipalem Village, Bhogapuram Mandal, Vizianagaram District for the purpose of allotting house sites to the poor persons under the Navaratnalu Programme without issuing any notice to the petitioner. 3. On the other hand, the learned Assistant Government Pleader relying upon the written instructions of the 4th respondent dated 20.03.2020 submits that the petitioner is not in possession of the subject land. For conversion of the provisions of APLA (POT) Act 1977, the assigned land in Sy.No.177/2P measuring an extent of Ac.1.41 cents and Ac.2.00 cents in Sy.No.188/22 of Kongavanipalem have been resumed to the Government and it is being utilized for the public purpose viz., for allotment of house sites to the needy poor and that other lands mentioned in this writ petition viz., Ac.0.21 cents in 4 HBKM,J W.P.No.7912 of 2020 Sy.No.177/4, Ac.0.08 cents in Sy.No.177/8, Ac.0.30 cents in Sy.No.177/9, Ac.2.00 cents in Sy.No.180/20 and Ac.1.35 cents in Sy.No.190/1 of Kongavanipalem Village are not in possession of the petitioner as contended and that there is no interference with the possession of the above said lands by the official respondents. 4. In view of the above said facts and circumstances, no further orders are necessary in this writ petition. However, the respondent Nos.2 to 4 are directed to deal with the subject land, if so warranted for any public purpose, strictly in accordance with law. 5. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs. The written instructions of the 4th respondent dated 20.03.2020 shall be made as part of the Court record.
