JUSTICE SAMEER JAIN Judgment 13/11/2025 The instant application has been filed for recalling of the order dated 02.04.2025 passed by this Court in S.B. Civil Writ Petition No.6241/2002. It is submitted that the said order was passed ex parte, however the Court had considered the merits of the case. Learned counsel for the applicant is not able to refute that a petition was filed in the year 2002 wherein the prayer for grant of selection grade was made. It is further submitted and admitted by the applicant that the petitioner has already been superannuated as of now. [2025:RJ-JP:45765] (2 of 2) [WMAP-333/2025] Considering the aforesaid, the matter has also been analyzed in view of the petitioner’s superannuation, thence, in totality of facts and circumstances, this Court is not inclined to grant any indulgence either on merits or on the application. Accordingly, the instant application stands dismissed. However, the contentions raised in the application have also been examined on merits.
