Hon’ble Ravindra Maithani, J.(Oral) By means of instant petition, the petitioners have sought the following reliefs:- “(i) To issue a writ, order or direction in the nature of mandamus directing the respondent to call other suitable candidates under physical handicapped (PD/PB) category who are in next line of merit for document verification of 5 post of Village Panchayat Development Officer (VPDO). (ii) To issue a writ, order or direction in the nature of mandamus commanding the Respondnet to declare afresh result final on the post of Village Panchayat Development Officer (VPDO) in pursuance of advertisement dated 13.10.2023 only after calling suitable candidates under physical handicapped (PD/PB) category who are in next line of merit for document verification. (iii) To issue any other writ order or direction, which this Hon’ble Court may deem fit and proper in the circumstances of the case. (iv) Award the cost of the writ petition in favour of the petitioners.” 2. Heard learned counsel for the parties and perused the record. 2 3. It is a grievance of the petitioners that the respondent/ Uttarakhand Subordinate Service Selection Commission (“the Commission”) is not filling up 5 posts of VPDO under Physically Handicapped (“PH”) category. 4. Learned counsel for the petitioners would submit that seven posts were reserved for PH category, out of which only two have been selected. The respondent/Commission ought to have called other candidates in the merit list so as to fill all the five positions reserved for the PH candidates. 5. Learned counsel for the respondent/Commission, under instructions, would submit that the process of filling up the position of five PH category candidates, which includes (PD/PB) is still underway. The candidates from merits are being called for verification and the process has yet not been concluded. Learned counsel for the respondent/Commission would submit that the process for filling up these positions may be completed by the respondent/Commission within a period of thirty days. 6. The Court takes on record the statement given by learned counsel for the respondent/Commission. 7. The writ petition is disposed of with the direction to the respondent/Commission to complete the process for filling up the position within a period of thirty days.
