Since the similar issues are involved in both the writ petitions, they are being heard and decided together. For the sake of convenience, the pleadings and documents of WPS No.569 of 2024 are being referred. 2. By these petitions, the petitioners seek directions towards the respondent authorities to declare the petitioners’ eligible for the post of Dresser Grade-II and treat the petitioners’ mark-sheet as valid pursuant to notification issued by the Chhattisgarh Board of Secondary Education (for short ‘the Board’). 3. Learned counsel for the petitioners would submit that the office of the respondent No.3 issued an advertisement for the post of Dresser Grade-II. The requisite qualification for the said post is class-10th . The petitioners are having the requisite qualification, they applied for the post and on due scrutiny of the documents, the petitioners were called for document verification and 3 / 4 counseling. In the said selection process, the respondent No.3 sent the mark-sheets of the petitioners for a verification to the Board, who, in turn, stated that the candidates who obtained mark-sheet between the period 07/11/2012 to 10/03/2014 are valid. Despite the said fact, the respondent authorities declared the petitioners ineligible for the post and thereafter, the less meritorious candidate have been called for document verification and counseling. 4. Learned counsel for the respondents submit would oppose the submission made by learned counsel for the petitioners and stated that the petitioners are not entitled to participate in the selection process as they are not having the valid certificate. 5. I have heard learned counsel for the parties, perused the pleadings and the documents. 6. From perusal of the of pleadings and documents, it is manifest that during the process of document verification, the respondent No.3 sent the mark-sheet of the petitioners relating to Class-10th which have been obtained by the petitioner from the Board of School and Technical Education on 25/07/2013 and 28/12/2012 respectively. During the verification of the said mark-sheet, the Board of Secondary Education categorically stated that the persons who obtained the mark-sheet from the Board of School and Technical Education between the period 07/11/2012 to 10/03/2014 are valid certificates. It is also noteworthy to mention here that the similar situated persons are considered and declared them eligible by the Forest Department for the post of 4 / 4 Forest Guard and despite the said fact, the respondent authorities are not allowing the candidature of the petitioners in the recruitment conducted by the office of respondent No.3 for the post of Dresser Grade-II. 7. In view of above, both the petitions are allowed. The respondent authorities are directed to allow the petitioners to the counseling and document verification for the post of Dresser Grade-II pursuant to the advertisement issued by the respondent No.3.
