Neutral Citation No. - 2025:AHC:62694 Court No. - 5 Case :- WRIT - A No. - 5313 of 2025 Petitioner :- Manikchand Respondent :- Food Corporation Of India And 4 Others Counsel for Petitioner :- Ashutosh Chaubey,Vikas Tiwari Counsel for Respondent :- Pranjal Mehrotra Hon'ble Ajay Bhanot,J. The petitioner is presently working to the post of Mandal. He claims to be entitled to be promoted to the post of Sardar. He has made a representation in this regard before the competent authority but to no avail. The only prayer made by Shri Vikas Tiwari, learned counsel and Shri Ashutosh Chaubey, learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time. Shri Hari Narayan Singh, learned counsel for the respondent nos. 1 to 5 contends that the petitioner was transferred from Naini to Azamgarh on departmental basis. Consequent to the aforesaid transfer and as per the relevant rules, the petitioner has been placed at the bottom of the seniority list. He however fairly contends that the claim of the petitioner requires determination of facts in light of applicable provisions of laws and government orders and departmental circulars by the competent authority in the first instance. In wake of the preceding discussion and without going into the merits of the case, the respondent No.2-
Divisional Manager, (I.R.L.), Bhartiya Khadya Nigam, Azamgarh is directed to execute the following directions: I. The respondent No.2-Divisional Manager, (I.R.L.), Bhartiya Khadya Nigam, Azamgarh shall prepare a seniority list and decide the claim of the petitioner regarding his eligibility for promotion to the post of Sardar after considering all facts and relevant service rules in accordance with law. II. Prior to preparing the seniority list objections shall be called from the concerned employees. III. The exercise shall be completed within a period of six months from the date of receipt of a certified copy of this
order along with a fresh copy of the representation. With the aforesaid directions, the writ petition is finally
disposed of.
