Learned counsel for the petitioner, after arguing for some time, seeks permission to withdraw this writ petition. However, he submits that a civil suit for eviction in respect of the suit property situated at Ward No. 18, Municipal Corporation Area, Raigarh, bearing Nazul Sheet No. 44, Plot No. 71, admeasuring 1378 sq. ft., was filed by the petitioner before the learned Civil HIFZURRAHMAN ANSARI Digitally signed by HIFZURRAHMAN ANSARI Date: 2025.10.29 17:16:33 +0530
2 Judge, which came to be dismissed. Aggrieved thereby, the petitioner preferred an appeal under Section 96 of the Code of Civil Procedure, 1908, which is pending consideration before the learned 4th District Judge, Raigarh (C.G.) since 27.01.2023. It is submitted that despite the lapse of more than one and a half years, the said appeal has not yet been decided. Accordingly, he prays that a direction may be issued to the learned appellate court to decide the appeal at the earliest.
2. The prayer appears to be fair and reasonable. Therefore, it is expected that the learned 4th District Judge, Raigarh shall make all endeavours to decide the aforesaid appeal expeditiously, preferably within a reasonable period of time.
