Pursuant to the recommendations of the PIL Committee, the Registry was permitted to take up the matter as Public Interest Litigation and accordingly, this taken up Public Interest Litigation came into being. 2. Out of the thirteen (13) respondents, the respondent no.4-District Collector and respondent no.7-Assistant Director of Mines & Geology, Kurnool District, filed counter-affidavits. 3. The counter-affidavits filed by respondents would indicate that excavation operations are being carried out in the subject area with the permission of Archeological Survey of India for the purpose of bringing out the culture and heritage to limelight and that too the investigation is going on strictly as provided under Section 4 of Mines and Minerals (Development and Regulation) Act, 1957. 4. In view of the above, since the excavations are going on to unearth the culture and heritage that too by taking assistance from Department of HCJ & RCJ WP(PIL) No.9 of 2018 3 Archaeology and Museum, the apprehensions of the petitioner are misplaced. Therefore, nothing remains for adjudication in this Public Interest Litigation and the same is liable to be closed. 5. Accordingly, this taken up Public Interest Litigation is closed.
