The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity 8the BNSS9) by the Petitioner/Accused No.2 for granting of pre-arrest bail in connection with Crime No.38 of 2025 of Gandepalli Police Station, Kakinada District, registered for the alleged offence punishable under Section 8 (c) read with Section 20 (b) (ii) (B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, 'the NDPS Act').. 2
2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. 3. This Court, in Crl.P.No.5811 of 2025 on 25.07.2025, dismissed the pre- arrest bail application filed by the petitioner and directed him to surrender before the Court concerned. The petitioner has not followed those instructions. The petitioner, through a different counsel, has filed the present petition. 4. The learned counsel for the petitioner submits that the petitioner is suffering from Acquired Immune Deficiency Syndrome and that he was in the hospital at the time of the alleged offence. The learned Assistant Public Prosecutor submits that the contraband consisted of eight bags, i.e., 359.950 kgs of ganja, which was transported in two vehicles vide six bags in an Eicher van and two bags in a Swift Dzire vehicle. The petitioner is the owner of one of the crime vehicle, namely the Swift Dzire, in which two bags of ganja were transported from one place to another. Accused No.1 was apprehended at the spot along with the vehicle, and he gave a confession implicating the petitioner. 5. Be that as it may, as this Court has already dismissed the first pre- arrest bail application, there are no merits in the present petition. The petitioner is directed to comply with the directions issued in the first bail application in Crl.P.No.5811 of 2025, dated 25.07.2025. Accordingly, the criminal petition is dismissed. 3
