1. Mr. T.A. Khan, learned Senior Counsel assisted by Mohd. Shafy, learned counsel for the petitioner.
2. Mr. Rajeev Singh Bisht, learned Additional C.S.C. for the State of Uttarakhand.
3. Petitioner was appointed as Patwari (Revenue Sub-Inspector) in District Tehri Garhwal vide order dated 03.02.2001. He was subsequently transferred from District Tehri Garhwal to District Dehradun by Divisional Commissioner, Garhwal Division, vide
order dated
23.01.2008.
4. The next promotional post to Revenue Sub-Inspector is Revenue Inspector and before promotion, one has to undergo requisite training. In District Dehradun, a select list was prepared of candidates, who were nominated for undergoing training. Since petitioner’s name was not included in that list, and according to him, persons, who were appointed as Revenue Sub-Inspector after him are also nominated for training, therefore, petitioner has approached this Court seeking the following reliefs:-
(i) To issue a writ order certiorari quashing the list dated 28.03.2025 (Annexure no. 1 to this petition), issued by the respondent no. 2 for the purpose of training of Revenue Inspector of 18th Batch.
(ii) To issue a writ order or direction in the nature of mandamus directing the
respondents to include the name of the petitioner in list of eligible candidates issued on 28.03.2025 and provide his the training of Revenue Inspector 18th batch like other candidates and place his name in the list of candidates in accordance of his date of substantive appointment i.e. 03.02.2001 and the respondents be further directed to promote the petitioner to the post of Revenue Inspector in accordance with his date of his substantive appointment i.e.
03.02.2001.
5. It is not in dispute that selection for training is to be made on the criteria of seniority subject to rejection of unfit.
6. A counter affidavit has been filed by District Magistrate, Dehradun in which it is mentioned that petitioner sought transfer from District Tehri Garhwal to District Dehradun, which was accepted by Divisional Commissioner, and in the
order, passed by Additional District Magistrate (Administration), Deharadun on 10.03.2008, it was specifically mentioned that since petitioner’s transfer to Dehradun is on his request, therefore, he would be placed at the bottom of the seniority list in District Dehradun. The
order passed by Additional District Magistrate is enclosed as Annexure – CA2 to the counter affidavit.
7. Learned State Counsel has drawn attention of this Court to the list of candidates, who are nominated for Revenue Inspector Training, which is enclosed as Annexure – CA3 to the counter affidavit.
8. Perusal of the said list indicates that Revenue Inspectors, appointed in District Dehradun upto May 2007, alone have been nominated for training. By virtue of
order dated 10.03.2008, passed by Additional District Magistrate
(Administration), Dehradun, petitioner cannot have any grievance against nomination of persons, who are appointed in District Dehradun upto May,
2007.
9. The submission made by learned Senior Counsel for the petitioner that petitioner was appointed as Revenue Sub-Inspector in 2001 and he was transferred, not on request but in public interest to Dehradun, gets belied by the document contained as Annexure – CA2 to the counter affidavit.
10. Learned Senior Counsel for petitioner could not substantiate his allegation that persons junior to petitioner in District Dehradun have been nominated for training.
11. Thus, there is no scope of interference in the matter. Accordingly, the writ petition fails and is hereby dismissed.
