JUSTICE SATYAVRAT VERMA ORAL ORDER 2 25-02-2026 1. Heard learned counsel for the petitioner, learned APP for the State and the learned counsel appearing on behalf of the informant. 2. The petitioner seeks bail in a case registered for the offences punishable under Sections 191(2), 190, 352, 351(2), 126(2), 115(2), 118(1), 109(1), 117(2), 303(2), 74 of the B.N.S., 2023. 3. Learned counsel for the petitioner submits that petitioner had earlier moved before this Court seeking regular bail by filing Cr. Misc. No. 52424/2025 and the same came to be rejected by an order dated 19.09.2025 with a liberty to the petitioner to renew his prayer for bail after framing of charge. It Patna High Court CR. MISC. No.77302 of 2025(2) dt.25-02-2026 2/3 is submitted that the charges were framed on 24.09.2025 and thereafter three witnesses have been examined and altogether there are seven witnesses. It is next submitted that the instant bail application has been filed on 31.10.2025 but then the bail application remained pending. 4. Learned A.P.P. and the learned counsel appearing on behalf of the informant opposes the prayer for bail of the petitioner. The learned counsel appearing on behalf of the informant submits that since three witnesses have been examined, as such the regular bail application of the petitioner be rejected, on which, the learned counsel for the petitioner submits that the regular bail application has been filed in terms of the liberty granted and the same was filed the moment charges came to be framed but since the case was not taken up and in the meantime three witnesses have been examined. It is also submitted that petitioner will not abscond rather will cooperate in the trial to prove his innocence. 5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned trial court Patna High Court CR. MISC. No.77302 of 2025(2) dt.25-02-2026 3/3 where the case is pending/successor court in connection with Dumariyaghat P.S. Case No.65 of 2025. 6. Further, one of the bailors of the petitioner shall be his Mama, namely, Vijay Pathak. 7. It is made clear that if the learned trial court comes to a conclusion that petitioner after his release is trying to delay the trial in any manner or is trying to tamper with the evidence, in that event, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner. amit/- (Satyavrat Verma, J) U T
