JUSTICE ANAND SHARMA Order 03/11/2025 The petitioner is present in person. It is stated that Coordinate Bench of this Court vide order dated 13.10.2023 passed in S.B. Criminal Misc. Petition No. 379/2020 directed for issuing fresh notices to respondent No.2 and compliance was to be made within a period of 5 days failing which, that petition was liable to be dismissed without further reference to the Court. It is stated that on account of lack of communication, the petitioner could not learnt about the fact that directions were given for taking steps within a period of 5 days and on account of bonafide ignorance, the compliance could not [2025:RJ-JP:44119] (2 of 2) [CRLMA-726/2023] be made and thereafter formal dismissal of the petition was recorded by the Registrar (Judicial) on 03.11.2023. The petitioner in person submits that he is keen to pursue the case on merits and also undertakes to make necessary compliance of order dated 13.10.2023 within a period of one week from today. For the reasons mentioned in the application, same is allowed. Order dated 13.10.2023 and consequential order dated 03.11.2023 are hereby recalled and S.B. Criminal Misc.
