JUSTICE ALOK KUMAR SINHA ORAL ORDER 3 23-02-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner apprehends his arrest in connection with Triveniganj P.S. Case No. 277 of 2025, registered for the offence punishable under Sections 126(2), 115(2), 352, 351(2), 118(1), 109(1), 3(5) of the B.N.S. 3. The case of the prosecution, in short, is that on 29.05.2025 at about 09:00 PM, when the informant was going to drop his labours Arun Sardar, Chintu Sardar & Kalicharan Sardar, the applicant accused Jyotish Kumar, Mahendra Kumar & Shankar Kumar shouted upon the informant that they did not want to see any person of Yadav Community and thereafter, the applicant accused Jyotish Kumar Azgar assaulted him with Patna High Court CR. MISC. No.87425 of 2025(3) dt.23-02-2026 2/3 ‘farsa’ by which his hand was injured and he fell down on the ground and became unconscious. Thereafter, his labours taken him to the Triveniganj Hospital where he got treatment. 4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has not committed any offence and there is no allegation of repeated blow by the petitioner on the informant. He further submits that due to intervention of relatives and well wishers of both the parties, matter has been compromised outside the Court and in this regard, a petition for granting leave to compromise and a petition of compromise has been filed. 5. Learned A.P.P. for the State opposes the prayer of anticipatory bail. 6. From the reading of the FIR, it transpires that the main assailant is the petitioner, who is said to have assaulted with ‘farsa’ by which the hand of the informant was injured and he fell down on the ground, although the injury has been reported to be simple but also it is to be noted that the petitioner has five criminal antecedent. Under these circumstances, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. Patna High Court CR. MISC. No.87425 of 2025(3) dt.23-02-2026 3/3 7.
