Order 19/11/2025
1. Apprehending their arrest in connection with FIR No.45/2024 registered at Police Station Mothpur, District Baran for the offences under Sections 332, 353, 34 of IPC, the petitioners have preferred this bail application under Section 482 BNSS.
2. Heard learned counsel for the petitioner and learned Public Prosecutor and perused the material available on record.
[2025:RJ-JP:46680] (2 of 3) [CRLMB-5380/2025]
3.
Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. He further submits that the persons named in the FIR viz. Jankilal, Parvat Singh and Banwari have been enlarged on anticipatory bail by co- ordinate bench of this Court on 26.06.2024. He argued that the case of the petitioners is on better footing from the persons named in the FIR. He contended that though several cases are pending against the petitioners, but in all those cases they are on bail. He contended that custodial interrogation is not required, hence, the bail application of the petitioners may be allowed.
4. Learned Public Prosecutor has vehemently opposed the bail application.
5. Considering the fact that the petitioner is ready and willing to co-operate with the investigation of the case, without commenting anything on the merits/demerits of the case, I deem it just and proper to allow the bail application of the petitioners.
6. Accordingly, the bail application under Section 482 BNSS is allowed and it is ordered that in the event of arrest of the petitioners- Arjun S/o Motilal, Komal S/o Lal Singh, Ramkumar S/o Bhagwan Lal, Rakesh S/o Ramraj, Annu S/o Ramniwas, Rambal S/o Mishrilal, Bheemraj S/o Motilal, Dheeraj S/o Gulabchand, Dilraj S/o Mohanlal, Ramniwas S/o Shri Balmukund and Sitaram S/o Balmukund, they shall be released on bail on thier furnishing a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-
[2025:RJ-JP:46680] (3 of 3) [CRLMB-5380/2025] (i) that the petitioners shall make themselves available for interrogation by a police officer as and when required; (ii) that the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and (iii) that the petitioners shall not leave India without previous permission of the court.
