2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record.
3.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. The name of the petitioner has not been mentioned in the FIR and no recovery has been affected from his physical possession. Counsel further submits that at the time of the so called incident, petitioner was
[2025:RJ-JP:21758] (2 of 2) [CRLMB-1388/2025] not on the spot. Charge-sheet has been filed. Petitioner is behind the bars since 26.08.2024. No fruitful purpose will be served by keeping the petitioner in incarceration. The trial of the case may take considerable time, hence the bail application of the petitioner may be allowed.
4. Learned Public Prosecutor has opposed the bail application and submitted that specific allegation has been leveled in the FIR against present petitioner which was corroborated by the statement of complainant-Ashok Kumar Yadav recorded before the trial Court and in light of gravity of the offence, the petitioner is not entitled to be enlarged on bail, therefore, the bail application may be dismissed.
5. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, especially petitioner has been named in FIR and statement of Ashok Kumar Yadav during trial but without expressing any opinion on the merits/demerits of the case, I am not inclined to allow the present bail application filed by the petitioner.
6. Hence, the present bail application is hereby dismissed.
