GP FOR HOME 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 19568 of 2023 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: <…to issue an appropriate writ, order, or direction mere particularly one in the nature of Mandamus, the action of the 3rd respondent in calling and pressurizing the petitioner to withdraw the complaint which was issued against the respondent Nos.4 to 6 on 07.07.2023 and threatening the petitioner not to go for land cultivation of his lands in the Dabbadi Village, Routhalapudi Mandal, Kakinda District, and further threatening to lodge false complaint against the petitioner, as being illegal, arbitrary and unconstitutional and violative of Articles 14, 19 (1) (g) and 300-A of the Constitution of India besides being in violation of the principles of natural justice and consequently direct the 3rd Respondent-Station House Officer not to coerce the petitioner to withdraw the complaint which was issued against the respondent Nos.4 to 6 on 07.07.2023 and not to go for land cultivation of his lands in the Dabbadi Village, Routhalapudi Mandal, Kakinda District pending disposal of the Writ Petition, in the interest of justice.…= 2. None represented on behalf of the petitioner. 3. It is the case of the petitioner that the respondent-police are calling the petitioner to the police station and pressurizing the petitioner to withdraw the complaint which was filed against the respondent Nos.4 to 6. 4. Sri P.Ajay Babu, learned Assistant Government Pleader for Home, on written instructions, would submit that the respondent No.4 approached the police and submitted a complaint against the petitioner and others. The respondent-police called the petitioner to the police station to enquire into the 4 said complaint. After due enquiry, it is found that the matter is purely civil in nature. Hence, the police have advised both the parties to approach the competent Civil Court. He would further submit that the petitioner did not lodge any complaint at Kotananduru Police Station. 5. Recording the same, this Writ Petition is disposed of. However, the police are directed not to call the petitioner to the police station without there being any crime registered against him. No order as to costs.
