Neutral Citation No. - 2025:AHC:112437 Court No. - 4 Case :- WRIT - A No. - 9471 of 2025 Petitioner :- Girdhari Lal And 6 Others Respondent :- State Of Up And 8 Others Counsel for Petitioner :- Surendra Pal Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. 1. Heard learned counsel for petitioner and learned Standing Counsel. 2. By means of this petition filed under Article 226 of the Constitution petitioner has questioned the decision/ order taken by the respondent No. 2 dated 22.01.2025 to cancel the selection by way of promotion of the working chainman with respondent Consolidation Department. 3. It is argued that the respondents had since already conducted the written examination as per rules, were not justified in cancelling the selection process. 4. On the contrary it is argued by learned Standing Counsel that as per the instructions obtained by him none of the petitioners has been working on the post of Chainman in the respondent Consolidation Department and therefore, they cannot maintain this petition. 5. Upon a pointed query being made to the learned counsel for the petitioners as to whether the petitioners had ever worked with the respondent establishment, learned counsel for petitioner has drawn the attention of the Court to the order dated 18.06.2024passed by the District Magistrate/ Deputy Director of Consolidation, Bareilly in which certain names were given. I have perused the order dated 18.06.2024 and I do not find name of any of the petitioners mentioned there except Anand singh Bisht but the petitioner No. 2 is also only Anand Singh and not Anand Singh Bisht. 6. In view of the above, since petitioner have not been working with the respondent consolidation department, they have no stake in the matter of selection to be conducted for promotion by the authority. 7. Accordingly, I decline to grant indulgence in the matter. 8.Petition thus is dismissed summarily.
