Vashum, learned GA appearing for the respondents No. 1 to 4 and Mr. L. Gunindro, learned counsel appearing for the respondent No. 5. The present writ petition has been filed with a prayer for issuing a direction to the respondents to pay the provisional pension due payable to the petitioner in terms of the Rule 9 sub-rule (4) of the MCS (Pension) Rules, 1977 read with Rule 69 of the said rules within a stipulated period. Mr. Ajoy Pebam, learned counsel appearing for the petitioner submitted that due to non-payment of the said provisional pension due payable to the petitioner in terms of the relevant rules, the petitioner and his dependants are suffering. The learned counsel, accordingly, prays for disposing of the present writ petition by issuing a direction to the respondents to pay the provisional pension due payable to the petitioner. Mr. Th. Vashum, learned GA appearing for the respondents No. 1 to 4 submitted that all the necessary papers of the petitioner required for payment of the provisional pension has been forwarded to the Administrative Department, however, because of the heavy work relating to the closure of the Financial Year, 2024 - 2025, the IN. 66 SHOUGRAKPAM DEVANANDA SINGH Digitally signed by SHOUGRAKPAM DEVANANDA SINGH Date: 2025.03.28 14:07:04 +05'30' WP(C) No. 26 of 2025 Contd…/- Administrative Department and other authorities of the Government will require some time for processing the payment of the provisional pension of the petitioner as well as issuing his termination order. The learned GA, accordingly, seeks to grant two months’ time to complete the said process. Mr. L. Gunindro, learned counsel appearing for the Office of the Accountant General submitted that the Office of the Accountant General may be given one month’s further time from the date of receipt of the necessary papers/ documents of the petitioner for completing the process for payment of the provisional pension due payable to the petitioner in terms of the relevant rules. Taking into consideration the submission advanced by the learned counsel appearing for the parties, this court is of the considered view that interests of justice will be served by directing the respondents No. 1 to 4 to complete the process for payment of the provisional pension of the petitioner and to issue termination order within a period of two months from the date of receipt of a certified copy of this order. Further, the respondent No. 5 is directed to complete the process for releasing of the provisional pension of the petitioner within a period one month from the date of receipt of all the necessary documents of the petitioner from the Government. Ordered accordingly. With the aforesaid directions, the present writ petition is disposed of. JUDGE Devananda -2-
