Order on Board 11.12.2025 1) By way of instant Petition 9led under Section 528 of Bhartiya Nagarik Suraksha Sanhita, the Petitioner is praying for quashment of the
order dated 07.11.2025 passed by the learned 3rd Additional
2 Principal Judge, Durg (C.G.) wherein the concerned Court had
directed for attachment warrant against the petitioner’s movable and immovable property. The petitioner is also praying to recall of the
order dated 30.10.2025 passed by this Court in CRMP No. 3199/2025 wherein the Hon’ble Court has directed the 3rd Additional Principal Judge, Durg to decide the applications of respondents 9led under Section 125(3) of CrPC withing a period of 120 days from the date of receipt of copy of this order. 2) Learned counsel for the petitioner submits that the petitioner has made several attempts to bring back the respondents as has also been admitted by the respondent in her application under Section 125 and the petitioner has made every possible attempt to keep the respondents with him. Learned counsel for the petitioner further submits that the petitioner wants to reside with the respondents and maintain them. He further submits that the petitioner will deposit 50% of the maintenance amount as awarded in maintenance case before the trial Court. 3) In view of the above submission of the learned counsel for the petitioner that the petitioner would deposit 50% of the awarded maintenance amount, this Court is of the opinion that subject to the petitioner depositing Rs. 2,50,000/- tomorrow i.e. on 12.12.2025 before the trial Court, no coercive steps/action shall be taken against the petitioner pursuant to the order dated 07.11.2025 passed by the 3rd Additional Principal Judge, Durg. 4) This Court is also directed to the petitioner to deposit remaining amount of maintenance awarded in maintenance case within a
3 period of 30 days from today, failing which this Order would lose its eBcacy and the authorities shall be free to take appropriate action against the petitioner in accordance with law. 5) Accordingly, the petition is disposed of.
