ORDER:
The instant Criminal Petition under Section 482 of the Code of Criminal Procedure, 19731 has been filed, by the Petitioner/Respondent, seeking quashment of the Proceedings against her in DVC No.61 of 2023 on the file of the Court of Special Judicial Magistrate of First Class for the Trial of Prohibition and Excise Offences, Nellore.
Heard learned counsel for the Petitioner and Ms. K.Priyanka Lakshmi, learned Assistant Public Prosecutor appearing for respondent No.1/State and
learned counsel for respondent No.2. Perused the material on record.
Learned counsel for the Petitioner would submit that it is a case where the mother-in-law filed a Domestic Violence case against the daughter-in-law. The Petitioner herein is the daughter-in-law of respondent No.2. The marriage of the petitioner with the son of 2nd respondent was performed on 11.2.2020 at Guntur. Further, the respondent No.2, who is mother-in-law, filed the present DVC as a counter blast to the cases by the petitioner herein which is the subject matter of CC No.101 of 2023 on the file of the Additional Junior Civil Judge, Ponnur for the offences punishable under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act and MC No.8 of 2023 on the file of the court of Additional Junior Civil Judge, Ponnur and HMOP No.78 of 2023 on the file of the Court of Principal Senior Civil Judge, Bapatla and DVC No.2 of 2023 on the file of the Court of Additional Junior Civil Judge, Ponnur. Further, this DVC case has

been filed with all false and frivolous allegations and pressurising the Petitioner herein to settle the matrimonial issues pending between the Petitioner and her husband. The present Criminal Petition is filed seeking quash of DVC No. 61 of 2023 on the file of the Court of Special Judicial Magistrate of First Class for the Trial of Prohibition and Excise Offences, Nellore, filed by the 2nd respondent.
Learned counsel for the 2nd respondent would submit that there is verifiable material against the Petitioner that needs to be decided at Trial and learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders.
At this juncture, learned counsel for the Petitioner restricted their prayer to dispense the presence of the Petitioner in the Trial Court.
Accordingly, this Criminal Petition is disposed of dispensing the presence of the Petitioner herein before the Trial Court, except on the specific dates as
directed by the Trial Court. The petitioner is at liberty to raise all her contentions in the defence before the Trial Court. Pending applications, if any, shall stand closed.
