This MCC has been filed for modification of order dated 19.08.2025 passed in WPC No. 4172 of 2025. 2. Learned counsel for the applicant prays to modify the order dated 19.08.2025 passed in WPC No. 4172 of 2025 to the extent of expunging/omitting the word “arbitrary” used in the findings recorded in paragraph no. 6 of the order in relation to the decision of the Board of Directors of the Steel Authority of India Limited in its 340th Meeting held on 21st and 25th July, 2008, in the interest of justice. 3. Learned counsel for the respondent raised no objection in this regard. 4. Heard learned counsels for the respective parties at length and 3 perused the record with utmost circumspection. 5. Para 6 of the order dated 19.08.2025 passed by this Hon’ble Court in WPC No. 4172 of 2025 reads as under: “6. On perusal of record, this Court found that the Board of Directors of the Steel Authority of India Limited in its 340th Meeting held on 21st and 25th July, 2008 have levied the arbitrary charges and increased the the lease rent. Then on 19.04.2013 the respondents issued a offer letter to the petitioner and the petitioner has approached the Court by way of this writ petition on 17.07.2025, i.e., after lapse of 17 years, therefore, it is crystal clear that the petitioner was sleeping over his right.” 6. On due consideration and for the reasons mentioned therein I am inclined to allow the present MCC. Para 6 of the order dated 19.08.2025 in WPC No. 4172 of 2025 will now be read as under: “6. On perusal of record, this Court found that the Board of Directors of the Steel Authority of India Limited in its 340th Meeting held on 21st and 25th July, 2008 have levied the charges and increased the the lease rent. Then on 19.04.2013 the respondents issued a offer letter to the petitioner and the petitioner has approached the Court by way of this writ 4 petition on 17.07.2025, i.e., after lapse of 17 years, therefore, it is crystal clear that the petitioner was sleeping over his right.” 7.
