No. 1 : Mr. Animesh Tiwari, Advocate For State : Mr. Satish Gupta, Govt. Advocate (HON’BLE SHRI JUSTICE BIBHU DATTA GURU) Order on Board 06/01/2025 1. By the present Writ Petition, the petitioners who are tenants of Raipur Development Authority (henceforth ‘the RDA’), are seeking directions towards the respondents to take decision on the pending applications for renewal and grant of permanent lease in favour of the petitioners. 2. Learned counsel for the petitioners submits that the petitioners had moved applications on 12/11/1999 and 29/11/2024 before the Chief Executive Officer, RDA, but they have not taken any decision on the applications submitted by the petitioners till date. 3. Per Contra, learned counsel for the RDA would submit that there are no provisions for renewal of tenancy under the agreement executed between the parties. However, he submits that if there is any application pending before the RDA for renewal of tenancy, the same shall be decided within the stipulated period in accordance with law. 4. I have heard counsel for the parties and perused the documents annexed with the writ petition. 5. From the pleadings, it appears that the applications for renewal of tenancy as well as for grant of lease were filed by the petitioners 3 before the RDA and the said applications are still pending before the respondents. Therefore, the respondents are directed to consider the said applications and pass an order in accordance with law within a period of 30 days from today. 6. With the aforesaid observations, the writ petition is disposed of. Sd/- (BIBHU DATTA GURU) JUDGE Rahul
