By presenting this writ petition, petitioner has prayed for issuance of appointment letter which would permit her to join the school in terms of recommendation memo dated 22nd March, 2024 issued by the Chairman, West Bengal Regional School Service Commission, Southern Region. It is submitted by Mr. Dasgupta, learned advocate representing the petitioner that though recommendation letter 2 was issued far back on 22nd March, 2024 till date neither West Bengal Board of Secondary Education nor authority of Children’s Welfare Association High School for Girls (HS), Kolkata has issued appointment letter in favour of the petitioner permitting her to join the post in the said school. West Bengal Central School Service Commission, West Bengal Board of Secondary Education and State respondents are represented by learned advocates. It is submitted on behalf of West Bengal Central School Service Commission that since procedure relating to issuance of appointment letter of Assistant Teacher has been changed to the extent that appointment letter based on recommendation issued by the Commission needs to be issued by the concerned authority of the West Bengal Board of Secondary Education, which was not prevalent at the time of selection process namely 12th Regional Level Selection Test (Assistant Teacher), 2011; the Board should be directed to issue appointment letter. it is submitted on behalf of the Board that if Court directs concerned authority of the Board 3 shall issue appointment letter in favour of the petitioner. Having considered the respective submissions made on behalf of the parties, writ petition stands disposed of directing the Secretary, West Bengal Board of Secondary Education to issue appointment letter in favour of the petitioner based on recommendation dated 22nd March, 2024 on compliance of necessary formalities by four weeks from date of communication of this order. There shall be, however, no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking. (Saugata Bhattacharyya, J.)
