G.P. for Finance Planning The Court made the following: 2 BSB,J W.P.No.31956 of 2025 ORDER: This writ petition is filed under Article 226 of Constitution of India seeking following relief: <...to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not releasing the pending final bill amount of Rs.10,84,573/- for the work of <Construction of New Rythu Bazar at Tellaki under AMC, Kotabommali in Srikakulam District= vide Agreement No.91/2016-17 and M.Book.No.112/A/2015-16 under Agriculture Marketing is illegal, arbitrary and Article 14, 19, and 21 of the Constitution of India and consequently, direct the respondents to pay the pending final bill amount of Rs.10,84,573/- as per agreement to the petitioner forthwith and to pass...= 2. It is the contention of the petitioner that even though the respondents admitted that the petitioner is entitled to the claim amount, no payment is made. The petitioner contends that such non-payment of money is clearly arbitrary and high-handed requiring the interference of this Court. 3. On the other hand, learned Assistant Government Pleader for Agriculture, while admitting about the agreement amount, placed on record instructions received from the respondent No.3 vide Letter No.WP/SKLM/RBZ Work/EEAMVSP, dated 24.11.2025. He further submitted that due to closure of CFMS portal, NIDHI portal was introduced by the government and that once NIDHI portal starts operating, petitioner’s bill would be submitted to the A.M.C. for releasing final payment. 3 BSB,J W.P.No.31956 of 2025 4. In view of the submissions of the learned counsel for the petitioner and the learned Assistant Government Pleader for Agriculture, this Writ Petition is allowed with a direction to the respondents to release the amount of Rs.10,84,573/- (ten lakh eighty four thousand five hundred seventy three rupees only) to the petitioner within a period of two (02) months from the date of receipt of a copy of this order.
