1. This is an o2ce reference.
2. This Court, vide order dated 16.04.2025, passed in MCRC No. 2154 of 2025, while allowing the bail of the petitioner, namely, Mukesh Agrawal, had expressed its trust that the trial Court should make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of six months from the date of passing of the order, if there was no legal impediment.
3. The learned Judicial Magistrate First Class, Mahasamund District- Mahasamund (C.G.) vide his request letter dated 13.10.2025 has KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 requested for grant of eight months time for concluding the trial.
4. It transpires from perusal of the PUD that the case has been repeatedly delayed due to non appearance of the accused persons at the stage of charge, <ling of separate miscellaneous applications for discharge by the accused and frequent non appearance of the prosecution witnesses. Although cognizance has been taken and charges have been framed, the accused have challenged both the cognizance and the charge, due to which the entire case record has been forwarded to the respected Appellate Court (Respected F.T.C. Court, Mahasamund, C.G.). Out of the total 20 prosecution witnesses, only one witness has been examined so far. As the case record is presently before the appellate Court and the remaining prosecution evidence cannot be recorded until the record is received back, the trial court has sought an extension of 8 months to ensure proper and timely completion of the trial.
5. The request made by the learned trial Court, is allowed, however, instead of granting eight months, this Court deems it appropriate to grant further 05 months time for concluding the trial from today.
6. Accordingly, this CRMP stands disposed o6 with the aforesaid direction.
7. Registry is directed to send a certi<ed copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
