He submits his instructions are, his client does not want to prosecute the appeal. There has been settlement and parties are back together. He submits further, order dated 9th March, 2024 of the Family Court recording settlement has been enclosed in withdrawal application dated 21st April, 2025. None appears on behalf of respondent-wife. Order sheet reveals there was direction for issuance of notice in the appeal, made by coordinate Bench on 4th December, 2021. Subsequent thereto order dated 16th December, 2021 was made by another coordinate Bench recording respondent's contention of also wanting to prefer appeal from impugned judgment dated 29th September, 2021 directing maintenance pendente lite. Now, appellant does not want to prosecute on submission that parties are back together. In view of aforesaid, the appeal has lost its force. It is dismissed.
