It has been submitted in the explanation that order passed by the Additional District Judge, Jammu was not conveyed to her officially and that, during the pendency of the suit, one of the defendants has passed away. It has been further submitted that the application for bringing on record legal heirs of the deceased- defendant is pending and all these factors contributed to delay in deciding the application under Order 39 Rule 1 & 2 of the Code of Civil Procedure, 1908 filed by the petitioners. It has also been stated that the case has now been posted to 10.10.2025. 3. Having regard to the circumstances explained by the learned Judicial Officer, no further proceedings are required to be taken in the matter. However, learned trial court is directed to decide the Sr. No. 06 2 CM(M) No. 253/2025 application for bringing on record legal heirs as well as the application under Order 39 Rule 1 & 2 of the Code of Civil Procedure, 1908 by 18.10.2025 and submit a report to the Registry of this Court, in this regard. 4. The petition is disposed of, accordingly. 5. A copy of this order be sent to learned trial court for information and compliance.
