1. This is the First bail application 8led under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 195/2025 registered at Police Station – Tilda Nevra, District – Raipur (C.G.), for the o=ence punishable under Sections 109, 296, 115(2), 351(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023. 2. As per the prosecution story, on 11.05.2025, at around 7:30 PM, near Nevra Liquor Shop, the applicant, along with other co-accused persons, allegedly assaulted Hamid Ali with a knife, due to which he sustained injuries on his stomach, and also abused him. Accordingly, an FIR was ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2025.10.28 15:37:11 +0530
2 lodged under Sections 109, 296, 115(2), 351(2), and 3(5) of the Bharatiya Nyaya Sanhita (BNS). 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He submits that the injuries sustained by the complainant were simple in nature, and the complainant was discharged from the hospital on the same day. He also submits that there was a sudden scuAe between the complainant and the applicant, without any intention or prior preparation. No weapon was used, and only hand and 8st blows are alleged against the applicant. He further submits that no weapon has been seized from the applicant. He also submits that the co-accused, namely, Vikrant Lahore, has already been granted regular bail by this Court in MCRC No. 7565 of 2025 vide order dated 19.09.2025, and the applicant has been languishing in jail since 13.05.2025, therefore, he prays that the applicant is also entitled for grant regular bail in the present case. 4.
On the other hand, learned State Counsel opposes the bail application of the present applicant and submits that the applicant, along with the co- accused, assaulted the injured person with a knife as well as with hands and 8sts, causing the victim to sustain grievous stab injuries on the abdomen along with other injuries. It is further submitted that the main allegation is against the present applicant, who inDicted the knife injury on the victim, therefore, the applicant is not entitled to the grant of regular bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the submissions of the learned counsel for the parties, the nature of the dispute, and the
3 material available in the case diary, and further considering the fact that the applicant, along with the other co-accused person, assaulted the injured person with a knife, due to which he received grievous stab injuries, further, the other co-accused, namely Vikrant Lahore was granted regular bail by this Court vide order dated 19.09.2025, however, the case of Vikrant Lahore is distinguishable, as he allegedly assaulted the victims with his hands and 8sts, resulting in simple injuries, whereas the present applicant's case involves more severe allegations, therefore, this Court is of the opinion that it is not a 8t case to enlarge the applicant on bail. 7. Accordingly, the 8rst bail application of the applicant – Raj Sendre, involved in Crime No. 195/2025 registered at Police Station – Tilda Nevra, District – Raipur (C.G.), for the o=ence punishable under Sections 109, 296, 115(2), 351(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9. OGce is directed to send a certi8ed copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
