Order 04/09/2025
1. This writ petition has been filed by the petitioner for assailing the suspension order dated 01.02.2024 and directions has been sought against the respondents to revoke the suspension order and to reinstate the petitioner along with all other benefits.
2.
Learned counsel for the petitioner submits that during the pendency of the writ petition, the suspension order has been
[2025:RJ-JP:35557] (2 of 2) [CW-5738/2025] revoked by the respondents however, the remaining benefits such as remaining salary after adjusting the subsistence allowance, seniority etc. has not been restored.
3. It is clear by pursuing Rule 54 of Rajasthan Civil Services Rules, 1951 that so far as the benefits of suspension period are concerned, decision is taken by the disciplinary authority or by competent authority after conclusion of the enquiry. In the instant case, the enquiry against the petitioner has not yet been concluded, therefore, the stage of claiming benefits under Rule 54 of the Rules of 1951 has not yet come.
4. In view of above, where the suspension has already been revoked, the writ petition filed by the petitioner is dismissed as having become infructuous with liberty to claim the benefits of suspension period as and when cause of action so arises.
