By way of the instant petition, the petitioner has prayed for the following relief:- It is therefore prayed that this Hon’ble Court may kindly be pleased to direct the respondent authorities to register an FIR in the matter and investigate the matter, to secure the ends of justice. This Hon’ble Court may kindly be pleased to pass any other order as it may deem fit in the interest of justice. 2. By way of the instant petition, the petitioner is challenging the inaction of the respondent authorities in investigation of the unnatural death of Dharmendra Prasad Kesari, brother of the petitioner, who had died under suspicious circumstances and his half burnt dead body was found. 3. Learned counsel for the petitioner would contend that no investigation in the matter has been done by the respondent authorities and he would next contend that the police has merely registered an inquest and has not investigated the matter. 4. Learned State counsel would submit that they have filed a covering memo dated 04/11/2024 and have filed a document of the office of the Director Medico Legal Institute Home (Police) Department, Medico Legal Expert and Medico Legal Advisor to Government of Chhattisgarh, Jail Road, Medical College, Building Raipur, wherein it has been opined that “on over all consideration of available documents I am of the opinion that nature of death appears to be suicidal, however, to finalize 3 / 3 the case circumstantial evidence should be taken into consideration”. 5. In view of the above, Respondents No.4 & 5 are directed to expedite the investigation in expeditiously as soon as possible. 6. With the aforesaid direction, the instant petition stands disposed of.
