The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.231/2024, registered at Police Station Bagicha, District Jashpur (C.G.) for alleged commission of offence AKHILESH KUMAR DEWANGAN Digitally signed by AKHILESH KUMAR DEWANGAN Date: 2025.01.11 14:26:58 +0530
2 punishable under Section 4, 5, 10 of Agricultural Animal Testing Act, 2004.

As per the case of the prosecution, the the applicant/accused, Mahindra Bhagat, is charged with killing a calf on 05.12.2024, at 9:00 am in Gram Samarbar, Jodabar Malhar Ghat, Bagicha Police Station, Jashpur district, Chhattisgarh, with the intention of eating it, using an axe (tangi). The complaint was filed by Baliram, and the Bagicha Police Station has registered a crime under number 231/2024 and started an investigation.

Learned counsel for the applicant submits that the is innocent and has been falsely been implicated in the crime in question, only on account of previous animosity of applicant with the complainant he has been implicated in the present case. He further submits that the applicant is head of his family, and his arrest will affect his social reputation, further the applicant is ready to furnish adequate surety and shall abide all the conditions and direction which this Court may impose upon him. He also submits that the applicant has no criminal antecedents against him. Hence he prays to enlarge the applicant on anticipatory bail.
4. On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submits that the applicant with an intention of eating, killed a calf on 05.12.2024 using an axe (tangi), therefore, the anticipatory bail application of the applicant deserves to be rejected.

Taking into consideration the nature of allegation made against the present applicant that the applicant with an intention of eating, killed a calf on 05.12.2024 using an axe (tangi), as such, I am not inclined to grant anticipatory bail to the applicant. Accordingly, the anticipatory bail application of the applicant - Mahindra Bhagat, involved in Crime No.231/2024, registered at Police Station Bagicha, District Jashpur (C.G.) for alleged commission of offence punishable under Section 4, 5, 10 of Agricultural Animal Testing Act, 2004, is rejected.
