HIGH COURT OF JUDICATURE AT ALLAHABAD SPECIAL APPEAL No. - 703 of 2013 Court No. - 29 HON'BLE MAHESH CHANDRA TRIPATHI, J.
HON'BLE ANISH KUMAR GUPTA, J.
1. This matter has already been directed to be listed peremptorily. Today, when the matter was taken up in the revised list, none appeared on behalf of the appellants to press the appeal, nor has any adjournment slip been moved. Shri Devesh Vikram, learned Additional Chief Standing Counsel for the State-respondents and Shri Anukul Uday, learned counsel holding brief of Shri P.K. Sinha, learned counsel for the respondent No.2 and 3 are present.
2. In the absence of any effective representation, it appears that the cause of action has become stale and the appeal has been rendered infructuous by efflux of time.
3. Accordingly, the writ petition is dismissed as infructuous. Interim order, if any, stands vacated.
4. In case the appellants feel that the matter still survives, liberty is granted to them to move an application for recalling this order within six weeks from today.
