The writ petition has been filed with the prayer to direct the respondent no.2 to consider the appointment of petitioner on the post of Shiksha Mitra in Prathmik Vidyalaya, Aktahiya area Desahi, District Deoria. Learned counsel for the petitioner submits that during pendency of the writ petition, the petitioner has already been given appointment on the said post, therefore, the petition has become infructuous, however, he has not been paid salary. Learned counsel for the petitioner prays to withdraw this petition with liberty to file fresh petition with fresh cause of action. Accordingly, the petition is dismissed with the aforesaid liberty.
