Order: This Criminal Petition under Sections 480 and 483 of B.N.S.S., has been filed by the petitioner/A3, seeking regular bail in Cr.No.89/2024 of Koyyuru Police Station, Alluri Sitharama Raju District.
2. The above said crime was registered against the petitioner/A3 and others for the offence punishable under Sections 20(b)(ii)(C), 25 r/w 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’).

Case of the prosecution, in brief, is that, this is a case of illegal possession of ganja and on 07.09.2024 at 17.00 hours on credible information the SI of Police along with staff and mediators reached Doddavaram Village Junction, Koyyuru Madal, ASR Manyam District and found the accused in possession and transporting the ganja in an auto bearing No.AP5TX8330 and found 105 kgs of ganja. Then the police seized the ganja under the cover of mediators report and registered the crime. Heard and perused the record.

Learned counsel for the petitioner submits that, based on the statements of co-accused the crime was registered against petitioner/accused No.3. Except for the confessional statement of co accused, no other independent materia! has been collected to show the involvement of the petitioner in the commission of the offence. The
learned counsel for the petitioner further submits that the petitioner has been in judicial custody in 04.01.2024 and the petitioner has a permanent abode at Lakkavarapupeta Panchayath, G.K.Veedhi Mandal, ASR District, and there is no possibility of his fleeing away from the Jurisdiction of the Court.
6. Learned Assistant Public Prosecutor, while opposing the prayer of the petitioner, submits that the investigation is not complete. When ascertained the learned Assistant Public Prosecutor confirmed petitioner has no criminal antecedents. that the

In view of the facts and circumstances of the case, since the petitioner herein is arrayed as accused No.3 basing on the confession statement of co-accused and the most of the witnesses are shown to be official witnesses, this Court is inclined to grant bail to petitioner/Accused No.3, on the following conditions; (i) The petitioner/A3 herein shall be released executing a personal bond for Rs.25,000/- (Rupees twenty on his
3 five thousand only) with two sureties for a like sum each to the satisfaction of the learned Judicial First Class Magistrate, Chinthapalli; (ii) On release, the petitioner shall appear before the Station House Officer concerned as and when required, (iii) The petitioner shall not tamper with the evidence and hamper the investigation and shall cooperate for investigation. Accordingly, the Criminal Petition is allowed.
