06.01.2025 Heard Shri Awadh Tripathi, learned counsel for the petitioner. Also heard Shri Shashank Thakur, learned Dy AG, appearing for the respondents/State.
1. The petitioner has filed the present petition with the following reliefs:-
“1) That, the Hon’ble Court may kindly be pleased to allow this petition and direct the respondents to produce the investigation report before the learned Judicial magistrate First Class Bilaspur (CG) within a stipulated period so that the proceedings of the complaint case filed by the petitioner under Section 156(3) can be completed, in the interest of justice. 2) Any other relief which this Hon’ble Court may deem fit and proper may also be passed in favor of the petitioner. An affidavit in support is filed herewith.”

Learned counsel for the petitioner would submit that petitioner has moved a complaint against respondents-2 to 7 before the Police Station Sarkanda, Bilaspur, District-Bilaspur for registering FIR but the Police has not considered the application of the petitioner. Thereafter, he filed an application under Section 156(3) of the CrPC on 21.12.2023 before the learned Judicial Magistrate First Class, Bilaspur seeking direction to
Wpcr 514 of 2024 3 respondent-2 for registration of the offence, in which learned trial court
directed to produce the inquiry report from the concerned Police Station but the same has not been produced till date.

Learned State counsel would submit that petitioner, despite several notices being given by the Police for recording his statement, he was not turning up for recording his statement before the authority, whereas, the statement of other non-applicants have been recorded in the matter. However, now, statement of the petitioner has been recorded and the Police is going to file the same within a week.
4. In view of the statement made by learned counsel for the State, present petition stands disposed of with a direction to the Police Officer of the concerned Police Station, to file the inquiry report within a period of two weeks from today before the Court of Magistrate concerned.
