SC FOR APTRANSCO The Court Made the Following Order:- This Writ Petition under Article 226 of the Constitution of India is filed for the following relief: <to issue any writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the respondents in issuing the revised Seniority list vide 2 Memo. DEE/TRS/VZM/Adm/JAO/SA/D.No. 786/2016 dated 3-8-2016 in the cadre of the Junior Lineman in the 4th respondent division for the purpose of effecting the promotion to the post of the Fitter-Grade.Il (Lineman) as illegal, arbitrary null and void and consequently set aside the same and allow the petitioner to continue as Fitter-Grade.II (Lineman) in the 4th respondent division...= 2. Today, when the matter is taken up for hearing, there is no representation on behalf of the petitioner. 3. The grievance of the petitioner is that the revised seniority list in the cadre of Junior Lineman in Respondent No.4 Division, prepared for the purpose of effecting promotions to the post of Fitter Grade-II (Lineman), is incorrect, and he seeks to have the same set aside and to be continued in service as Fitter Grade-II (Lineman) in Respondent No.4 Division. 4. Learned Standing Counsel for the respondent-Corporation, on written instructions, would submit that the promotion orders to the post of Instrument Mechanic Grade-II have been issued to the petitioner. 5. For ready reference, the written instructions are extracted hereunder: <Again the petitioner filed a CC No.2180 of 2017 in WPMP No.49833 of 2016 in WP No.40442 of 2016. Para 3 wise remarks were furnished to the then SLA vide Lr.No.DEE/TRS/VZM/Adm/JAO/SA/D.No.285/2019, Dt.30. 03.2019. Subsequently, promotion orders to the post of Instrument Mechanic Gr.II issued to the above petitioner vide Memo.No.DEE/TRS/VZM/JAO/SA/D.No.497/18,Dt.30 .06.2018. Counter Affidavit was furnished to the then SLA in Lr.No.EE/TRS/VZM/Adm/JAO/SA/D.No.707/2019, Dt.05.08.2019.= 6. A plain reading of the written instructions submitted by the learned Standing Counsel for the respondent-Corporation indicates that the petitioner was promoted to the post of Instrument Mechanic Grade-II vide Memo dated 30.06.2018 and has been continuing in the said post since then. 7. In view of the submissions made by the learned standing counsel for the respondents-corporation and in view of the contents of the written instructions, no further orders are required in the writ petition. Hence, the writ petition is closed. No costs.
