2. This is an application for recording of settlement and grant of divorce by mutual consent. However, the learned Counsel for the applicant, on instructions, states that now the respondent is not ready to present herself before the Court as to record a compromise and prayed that the appeal may be heard finally on merits.

disposed of in view of the statement of the learned Counsel for the applicant.
