The present application under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed to quash the order dated 18.3.2025 passed by Additional Sessions Judge, Court No. 6, Kanpur Dehat, whereby charge has been framed in Session Trial No. 34 of 2025 (State Vs. Balwan Singh and others) arising out of Case Crime No. 126 of 2022, under Sections 323/34, 325/34, 308/34 of I.P.C., Police Station- Kakvan, District- Kanpur Nagar as well as order dated 10.2.20205 passed by Additional Sessions Judge, Kanpur Dehat, whereby preliminary order of framing charge has been passed. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file appropriate application/proceedings before the court of competent jurisdiction. The instant application is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.
