1 Serial No. 05 Supplementary List HIGH COURT OF MEGHALAYA AT SHILLONG MC(WPC) No. 32 of 2025 Date of Order: 27.02.2025 Umpohliew Central Bonded Vs. State of Meghalaya & Anr. Warehouse Coram: Hon’ble Mr. Justice H. S. Thangkhiew, Judge Appearance: For the Petitioner/Applicant(s) : Dr. N. Mozika, Sr. Adv. with Mr. M.L. Nongpiur, Adv. For the Respondent(s) : Mr. A. Kumar, AG with Ms. S. Laloo, GA. i) Whether approved for reporting in Yes/No Law journals etc.: ii) Whether approved for publication in press: Yes/No Oral: 1. This is an application for extension of the stay order dated 29.11.2024, till the next date fixed i.e. on 06.03.2025, for hearing of the main writ petition. 2. It is submitted by Dr. N. Mozika, learned Senior counsel for the applicant that when the matter was last taken up on 24.02.2025, the stay order that had been operating was not extended. As such, he prays that as 2025:MLHC:117 2 the matter is due to come up for final disposal on 06.03.2025, the interim order be extended, so that the cause of action survives for consideration. 3. Mr. A. Kumar, learned AG for the State respondents has raised vehement objections and submits that the interim order was passed in consideration of the fact that the State respondents were not taking any positive action at that point of time, whereas the State Government at this juncture is in contemplation of implementing the policy decision for creation of more Central Bonded Warehouses. He further submits that the situation as such now does not call for the extension of the interim order. He further submits that the prima facie satisfaction for grant of interim order has also not been substantiated by the petitioner. He therefore prays that extension be not granted and the matter be posted for hearing. 4. Having heard the learned counsel for the parties and appreciated their submissions, it is however seen that as the date for hearing is next week on 06.03.2025, in all fairness, the interim order shall stand extended until the next date. It is understood that on the next date no further adjournment will be taken. 5. Misc. Case accordingly stands closed and disposed of.
