By the present writ petition, the petitioner is seeking a direction towards the respondents No.6 & 7 i.e. Gram Panchayat Kanharpuri and Panchayat Secretary, Gram Panchayat, Kanharpuri respectively to stop further construction over the land bearing Khasra No.142 and further the allocation of the abadi land and the parts of land bearing Khasra No.111 which is reserved as a gaothan. 2. The contention of the petitioner is that, the construction made by the petitioner over the said land has been demolished by the respondents in spite of the order of Tahsildar where the proceeding were going on. 3. Learned counsel appearing for the State, on instruction, submits that though there is an interim order passed by the Tahsildar but the said proceeding has been transferred to SDO (Revenue), Gurur, District Balod and the matter has been fixed by the SDO for presence of the parties on 22/01/2025 and the SDO will decide 3 / 3 the grievance of the petitioner including the grievance of the Panchayat by providing opportunity of hearing to both the parties. 4. I have heard learned counsel for the parties and perused the documents. 5. As stated by the learned State counsel that, the proceeding about the dispute is pending before the SDO, Gurur and a fixed date has been given for hearing and presence of both the parties on 22/01/2025, the petitioner is directed to appear before the SDO, Gurur and submit his grievance before him and the SDO, Gurur by providing sufficient opportunity to all the concerned parties decide the dispute within a period of 50 days from the date of 22/01/2025. Till the order of the SDO, status quo, as it exists today, be maintained by all the parties, over the subject land. 6. With the aforesaid direction, the writ petition is disposed of.
