The petitioners have preferred this bail application under Section 482 of BNSS in FIR No.83/2024 registered at Police Station Chitrakoot, District Jaipur West for the offence under Sections 420, 406, 120B IPC and Section 4/5 of the Prize Chits and Money Circulation Schemes (Banning) Act, 1978 and Section 3/21 of the Banning of Unregulated Deposit Schemes Act, 2019.
2. Heard learned counsel for the petitioners and learned Public Prosecutor and perused the material available on record.
3.
Learned counsel for the petitioners submits that the involvement of the petitioners in the offence is questionable in this case and in pursuance of the order of this Court 27.10.2025 the
[2025:RJ-JP:45906] (2 of 2) [CRLMB-3801/2025] petitioners have joined the investigation and investigation is over. He argued that there is no need of custodial interrogation of the petitioners, hence the bail application may be allowed.
4. On the contrary, learned Public Public Prosecutor has submitted that as per the contents of the FIR, there is clear involvement of the petitioners in the offence and money has been transferred in their accounts, therefore, this is a case of cheating by inducement to complainant to pay the money, hence petitioners are not entitled for benefit of anticipatory bail.
5. On consideration of the rival submission and material available on record and in light of submissions made by learned Public Prosecutor especially prima facie involvement of the petitioners, but without expressing any opinion on the merits/demerits of the case, I am not inclined to grant benefit of anticipatory bail to the petitioner.
6. Accordingly, the bail application under Section 482 B.N.S.S. is dismissed.
