GP FOR CIVIL SUPPLIES The Court made the following: 3 VS,J W.P.No.25555 of 2025 ORDER: The present Writ Petition is filed under Article 226 of Constitution of India seeking the following relief: “…to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of respondents in not reallocating the Fair Price No.0744030 at Tripurapuram village, Nujendia Mandal, Palnadu District even after recommendation of the 3rd respondent through RC.No.93/2025/DT dated 18.02.2025 there by considering the representation dated 4.3.2025 is arbitrary and against the principles of natural justice, violation of Article 21 and 14 and contrary to the Essential Commodities Act and consequently direct the respondents to consider the petitioner’s representation dated 04.03.2025 for reallocation of Fair Price Shop No.0744030 at Tripurapuram Village, Nujendia Mandal, Palnadu District, thereby considering the 3rd respondent proceedings RC.No. 93/2025/DT dated 18.02.2025…” 2. The case of the petitioner is that he was appointed as the permanent Fair Price Shop dealer of Shop No.0744030 of Tripuranpuram Village, Nujendla Mandal, Palnadu District by the then Revenue Divisional Officer, Narasaraopeta vide proceedings in Rc.No.3425/2017-B dated 25.11.2017. The petitioner paid the requisite security deposit to run the shop until 2019 and diligently discharged his duties without any irregularities. However, in the year 2019, the petitioner had to temporarily relinquish operations due to ill health. Thereafter, the said shop was allocated to a women’s self-help group on temporary basis. After his health was restored, on 19.11.2024, the petitioner applied to resume his dealership. The 4th respondent, after due enquiry, submitted a detailed report dated 18.02.2025 recommending the reallocation of Fair Price Shop No.0744030 at Tripurapuram Village, Nujendla 4 VS,J W.P.No.25555 of 2025 Mandal, Palnadu District in favour of the petitioner by proceedings dated 18.02.2025. In pursuance of the said recommendation, the petitioner submitted a representation to the 3rd respondent on 04.03.2025, requesting implementation of the same. As no action has been taken on the said representation, the petitioner was constrained to file the present writ petition on 11.09.2025. 3. Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies. 4. Today, when the matter came up for hearing, the learned Assistant Government Pleader for Civil Supplies brought to the notice of this Court that, in pursuance of the representation submitted by the petitioner, the 3rd respondent has already issued an endorsement dated 16.09.2025, whereby the recommendations made by the 4th respondent on 18.02.2025 for reallocation of the Fair Price Shop were rejected. A copy of the said endorsement has been placed on record. 5. In view of the same, nothing survives for adjudication in the present Writ Petition. 6. Accordingly, the Writ Petition is closed, giving liberty to the petitioner to challenge the endorsement dated 16.09.2025 issued by the 3rd respondent.
