CASE HAVING COME UP FOR ADMISSION ON 18.03.2025, THE COURT ON THE SAME DAY PASSED THE FOLLOWING: 2025:KER:23240 CRL.MC NO. 2597 OF 2025 2 ORDER The challenge in this Crl.M.C is against the order of the trial court dismissing the application for discharge filed by the petitioner and of the revisonal court, affirming that order. 2. The short facts are as under; The petitioner is the accused in CC.No.1415 of 2023 on the files of the Judicial Magistrate of First Class -1, Chengannur. The case originated from Crime No.53 of 2014 registered at the Chengannur Police Station for offences punishable under Sections 468 and 471 of IPC. The crime was registered on the allegation that the petitioner had forged the Trade Certificate of Government ITI, Chengannur and obtained employment abroad. 3. Learned counsel for the petitioner contends that, other than unsubstantiated allegations, there is no material to prove that the petitioner had not attended the course and was not issued with the certificate. 4. Learned Public Prosecutor asserted that the course mentioned in Annexure A1 certificate was not being taught in any of the institutions at that point of time. 2025:KER:23240 CRL.MC NO. 2597 OF 2025 3 5. Having heard the learned counsel on either side and after going through the impugned orders, this Court is of the definite opinion that the contentions now urged will have to be decided based on the evidence tendered. The Crl.M.C. is hence closed, reserving petitioner’s right to raise all contentions before the trial court.
