1. By the present writ petition, the petitioner is seeking a limited relief that is, for early disposal of appeal under Section 44 of CGLRC which is pending before the Divisional Commissioner Sarguja
3 division respondent No. 11 bearing appeal no. 202206960100066/B-121 “Rampyari Bai vs. Bechu Prasad”.
2. Learned counsel for the petitioner would submit that the appeal under Section 44 is filed by the respondent against the order of the SDO Ambikapur dated 02.05.2022, which is pending since 07.06.2022, but the same has not been decided by the Commissioner till date. Learned counsel for the petitioner further submit that Divisional Commissioner be directed to decide the pending appeal within a stipulated period.
3. Learned counsel for the State would submit that as the appeal has been filed in the year 2022, the same shall be considered and final
order will be passed within a stipulated period.
4. I have heard both the parties and perused the appeal memo dated 07.06.2022 (Annexure P/1).
5. As the appeal has been filed in the year 2022, the writ petition is
disposed off with a direction to the Commissioner to decide the appeal of the respondent 1 to 3, where the petitioner is a respondent in that appeal proceeding within a period of 50 days from today.
6. With the aforesaid direction, the writ petition is disposed of. Sd/-
