The present application under Section 528 of B.N.S.S. has been filed to issue a direction to release the applicant in 9 cases on the basis of personal bond and two sureties, which are as follows: (i) Case Crime No. 772 of 2019, under Section 393 of I.P.C., P.S. Barra, District Kanpur Nagar. (ii) Case Crime No. 185 of 2019, under Sections 392, 411 of I.P.C., P.S. Swaroop Nagar, District Kanpur Nagar. (iii) Case Crime No. 428 of 2019, under Section 307 of I.P.C. P.S. Chamanganj, District Kanpur Nagar. (iv) Case Crime No. 430 of 2019, under Section 3/25 Arms Act, P.S. Chamanganj, District Kanpur Nagar. (v) Case Crime No. 979 of 2019, under Sections 392, 411, I.P.C., P.S. Chakeri, District Kanpur Nagar. (vi) Case Crime No. 401 of 2019, under Sections 352, 411, I.P.C., P.S. Chamanganj, District Kanpur Nagar. (vii) Case Crime No. 923 of 2019, under Sections 392, 411, I.P.C., P.S. Kalyanpur, District Kanpur Nagar. (viii) Case Crime No. 955 of 2019, under Sections 392, 411, I.P.C., P.S. Chakeri, District Kanpur Nagar. (ix) Case Crime No. 457 of 2019, under Sections 392, 411, I.P.C., P.S. Panki, District Kanpur Nagar. Learned counsel for the applicant submits that the applicant is a poor person. It is further submitted that applicant has been implicated in all the cases on the basis of confessional statement. Except the confessional statement (which is irrelevant) there is no other pre-summoning evidence. One case is related to police encounter no injury case. Last bail order of the applicant has been passed on 21.10.2020. It is further submitted that applicant is languishing in jail since 4.12.2019. In view of the facts and circumstances of the case, Jail Superintendent is directed to release the applicant in all the 9 cases after furnishing personal bond of Rs. 50,000/- and two sureties of like amount to the satisfaction of the court concerned, in the aforesaid 9 cases. The applicant is directed to furnish two sureties of like amount within 15 days of his release. With the aforesaid directions, the application stands disposed of finally. Order Date :- 14.5.2025 T.
