The above contempt case is filed complaining non-implementation of the order dated 02.08.2022 in W.P.No.23655 of 2022. 2. 3. The petition filed writ petition to declare the action of respondents jp withholding a sum of Rs.2,35,257/- from the retirement gratuity and not paying the APGLI and GIS benefits, as illegal and arbitrary. 4 The writ petition was disposed of on 02.08.2022 directing the 2 respondent therein i.e. the Principal Chief Conservator of Forests, Guntur to deal with the representation dated 16.05.2022, said to have been made by the petitioner, if the same is received and pending before the authority. nd 5. Sri G.Raju, learned counsel for the respondent would submit that a speaking order Ananthapuramu was passed by the District Forest Officer, vide Proc.No.346/2016-TO, dated 26.04.2025 considering the representation of the petitione.r, however, with delay. some 6. As seen from the order in the writ petition, the grievance of the petitioner is that the respondent authorities withheld the gratuity and not paying the APGLI and GIS. The operative portion of the speaking order passed by the District Forest Officer, Ananthapuramu reads thus: retirement “In view of the circumstances explained above facts of the case and also undertaking submitted by the individual taken into consideration, it is inevitable to say that it is not feasible to issue clear No-Due Certificate and also not to release the withheld amount of Rs.1,19,850/- (Rupees one lakh nineteen thousand eight hundred and fifty only), since, the rates adopted °r digging of various sizes of pits i.e. 1 mt x 1 mt x 1 mt, 1 mt x 1 mt x 0.60 and 0.75 mt x .75 mt x 0.60 mt for the year s 2011-12 to 2013 to 14 in Ananthapuramu Division as per the CSSR earth work excavation with 'Machine i mt \ “ \ the IS under finalization with the competent authority”. 7. Thus, the District Forest Officer Ananthapuramu, being the competent authority passed a speaking order in pursuance of the order passed in the writ petition. Since a speaking order was passed, this Court does not find any violation in the order dated 02.08.2022 iin W.P.No.23655 of 2022. 8. Accordingly the Contempt Case is Closed, leaving it open to the petitioner to challenge the proceedings dated 26.04.2025 aggrieved, before the appropriate forum. No order as to costs.
