PUBLIC PROSECUTOR The Court made the following Order: Heard learned counsel for the petitioner and learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel for the petitioner submits that the petitioner is arrayed as accused in Crime No.191 of 2025, for alleged offences under Sections 333, 109(1), 308(6), 78(1)(i), 351(3), 324(4) of BNSS Act. It is submitted that the mobile phone of the petitioner was seized under cover of panchanama. The petitioner was also enlarged on bail on 28.01.2025. It is 2 submitted that the mobile phone would have to be maintained properly to ensure that the instrument would not be damaged. In this regard, the petitioner initially filed a petition before the Principal District Judge, Eluru and the same was returned with an endorsement that the same should be filed before the proper court. The petitioner filed Crl.M.P. before the II Additional Junior Civil Judge, Tadepalligudem and the same was returned with an endorsement that the offences against the petitioner are triable by the learned Sessions Judge, and as such, the petition was returned. Aggrieved by the same, the petitioner filed the present petition. 3. Considering the submissions, the learned II Additional Junior Civil Judge, Tadepalligudem, is directed to take on file the Crl.M.P. and decide the petition filed by the petitioner under Section 503 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, “BNSS”), in accordance with law. 4. Accordingly, the Criminal Petition is disposed of. 5. As a sequel, pending miscellaneous petitions, if any, shall stand closed. ______________________ JUSTICE HARINATH.N Date : 05.05.2025 BMS
