1. Learned State counsel submitted that the case diary is available with him. 2. With the consent of the parties, the matter is heard finally. 3. Earlier, the first bail application preferred by the applicant i.e. MCRC/2012/2024 was dismissed as withdrawn vide order dated
10.04.2024. 4. This is the 2nd bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for the grant of regular bail as he was arrested on 03.09.2023 in connection with Crime No. 191/2022 for the offence punishable under Sections 409, 419, 420, 467, 468, 471 and 120(B) of IPC registered at Police Station- Kotara Road, District – Raigarh,
2 Chhattisgarh. 5. As per the prosecution story, at the relevant time, the applicant - Rahul Sharma was posted as Branch Manager of Chhattisgarh Rajya Gramin Bank, Branch Karodimal Nagar, Raigarh. Being an employee of a Bank, he committed criminal breach of trust and embezzlement of KCC amount i.e. Rs. 3,57,13,100/-. It is also alleged that he transferred the amount into the bank account of his mother. On report being lodged to the above effect, the offences punishable under Sections 419, 420, 409, 467, 468, 471 and 120B of the IPC were registered against the present applicant and during the course of investigation, he was arrested. 6. Learned counsel appearing for the applicant submitted that the applicant has been in jail since 03.09.2023 and till date, the charges have not been framed. He would further submit that other co-accused has already been enlarged on bail; thus, he would pray that the applicant may be enlarged on regular bail. 7.
On the other hand, learned counsel appearing for the State would oppose the submissions made by learned counsel for the applicant and submitted that there are serious allegations against the present applicant with regard to the misappropriation of Rs. 3,57,13,100/- of KCC while he was posted as Branch Manager of Chhattisgarh Rajya Gramin Bank, Branch Karodimal Nagar, Raigarh. It is further submitted that the applicant transferred the alleged amount to his own bank account thereafter, transferred to his mother’s bank account; thus no case is made out for the grant of bail. 8. Heard learned counsel for the parties and perused the case diary. 9. Taking into consideration the fact that against the present applicant, there are serious allegations as he embezzled Rs. 3,57,13,100/- and transferred
3 that amount from KCC accounts to his mother’s account, further, looking at the nature and gravity of offence, I am not inclined to allow this application. Accordingly, the instant application for the grant of bail is hereby rejected. Sd/-
